Dieses Kind sei nämlich dadurch Mitbesitzer der Wohnung geworden, dass es zwischenzeitlich ausgezogen und nach einiger Zeit wieder in die elterliche Wohnung eingezogen sei.

Der Mieter konnte die Zwangsräumung nicht verhindern. Ein selbstständiger Räumungstitel gegen das zwischenzeitlich volljährig gewordene Kind war nicht erforderlich.
Kinder von Mietern sind auch nach Erreichen der Volljährigkeit nicht neben ihren Eltern als Besitzer einer Mietwohnung anzusehen. Auch ein zunächst erfolgter Auszug und ein erneuter Einzug in die elterliche Wohnung führen zu keiner für den Vermieter nachteiligen Veränderung der Besitzverhältnisse (LG Berlin, Beschluss v. 17.10.11, Az. 51 T 589/11).
